Welcome to the CountryEnough.com website (the "Site"). These Terms & Conditions (the "Agreement") form a binding legal contract between you, the user, and Country Enough LLC ("Country Enough", "we", "us", or "our"). This Agreement outlines the rules for your access and use of the Site and any purchases you make from it.

By using or accessing this Site, you confirm your full agreement to follow and be bound by these Terms & Conditions.

Please review this entire Agreement carefully, as it impacts your legal rights. It requires resolving disputes in Oklahoma County on an individual basis and strictly prohibits class-action lawsuits or participation in any representative legal proceedings.

1. General Provisions

This Site is offered and available only to users who are at least 18 years of age and reside within the United States. By using the Site, you confirm and warrant that you meet these minimum eligibility requirements. If you do not meet them, you are strictly prohibited from accessing or using the Site.

2. Supplemental Rules

In some cases, specific rules or conditions may apply to certain parts of the Site, the purchase of particular products, or your involvement in promotions, contests, or loyalty programs offered by Country Enough. Supplemental Terms are considered part of this overall Agreement. Should there be any contradiction between a provision in this main Terms & Conditions document and a provision in any Supplemental Terms, the provision within this main Terms & Conditions document will always govern and prevail.

4. Content Accuracy and Changes

Country Enough strives to ensure that the material (the "Content") on the Site is accurate and current. However, we cannot guarantee that the information will be entirely free of errors, omissions, or inaccuracies (such as errors related to product descriptions, pricing, or availability).

Country Enough maintains the right to correct any error, inaccuracy, or omission, or to update or change the Content at any time without providing prior notice to you. We may also change, move, remove portions of, or add to the Site as needed. We are not obligated to make these corrections or updates.

5. Intellectual Property and Site Content

All materials appearing on the Site, including images, graphics, product designs, text, videos, logos, and trademarks (collectively, the "Content"), are protected by copyrights, trademarks, trade dress, and other intellectual property rights. This IP is owned, controlled, or licensed by Country Enough LLC.

The name Country Enough is a trademark for which registration is pending. The names Country Enough, CountryEnough.com, and any other related trademarks, service marks, and logos displayed on the Site are the property of Country Enough LLC. You agree not to use or display any of these marks without our prior written consent.

No right or title to any Content or software is transferred to you by downloading it. You are not permitted to reproduce, publish, transmit, distribute, modify, create derivative works from, sell, or exploit the Content or the Site in any way, except as expressly permitted herein.

All rights and licenses not explicitly granted to you in this Agreement are strictly reserved by Country Enough LLC.

6. User-Generated Content

The Site may allow you to submit, upload, or post comments, reviews, feedback, suggestions, ideas, and other materials (collectively, "Submissions").

When you provide a Submission, you grant Country Enough a world-wide, permanent, perpetual, royalty-free, non-exclusive, and sub-licensable license to use, copy, distribute, modify, display, translate, create derivative works from, and publish such Submissions for any legitimate business purpose, in any media format, without any compensation to you. You retain your intellectual property rights in your Submissions.

You agree not to submit any Content that infringes on the rights of a third party (including privacy or IP rights) or that is libelous, unlawful, abusive, or obscene. Country Enough is not responsible for maintaining the confidentiality of any Submissions.

7. Your Privacy and Communications

All information collected on the Site is subject to our Privacy Policy, which is located at https://countryenough.com/policies/privacy-policy and is incorporated into this Agreement.

Email Communications

By voluntarily providing your email address, you agree that Country Enough may send you email messages regarding site changes, products, services, or promotions, unless and until you choose to opt-out, subject to the terms of our Privacy Policy.

8. Purchasing Products

If products are available for purchase on the Site, you may be required to supply information relevant to your purchase (such as credit card details, billing, and shipping information). You confirm that you have the legal right to use any payment means utilized for your purchase.

Country Enough reserves the right to limit the quantity of any product, change product descriptions or prices without notice, and refuse to honor promotional codes. You agree to pay all charges incurred, including shipping and handling, at the prices effective when the charges are incurred.

We reserve the right to cancel any orders based on errors or inaccuracies on the Site. If your credit card has been charged for a canceled order, a credit will be promptly issued.

9. Links to External Sites

The Site may contain links to external services and resources. Country Enough does not control the availability or content of these external sites and is not responsible for their content or any concerns regarding them. The inclusion of any link does not imply endorsement by Country Enough.

10. Appropriate Site Usage

You agree to use the Site strictly for lawful, personal, and non-commercial purposes (other than making purchases). You may not use the Site to post, download, copy, distribute, or display material that violates any law, infringes on another party’s rights, or is libelous, abusive, or obscene.

You are strictly prohibited from violating the Site’s security measures, including:

  • Using a false email or one belonging to another person.

  • Attempting to test the vulnerability of the system or breaching authentication measures.

  • Interfering with service to any other user, host, or network.

  • Sending unsolicited promotional emails ("spam").

Country Enough reserves the right to determine if any use violates these rules and will cooperate with law enforcement if a violation occurs.

11. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES, EITHER EXPRESSED OR IMPLIED.

COUNTRY ENOUGH DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SITE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT THE SERVER IS FREE OF VIRUSES OR HARMFUL COMPONENTS. YOUR USE OF THE SITE IS ENTIRELY AT YOUR OWN RISK.

12. Limitation of Liability

REGARDLESS OF THE LEGAL THEORY (CONTRACT, NEGLIGENCE, STATUTE, OR OTHERWISE), IN NO EVENT SHALL COUNTRY ENOUGH OR ITS AFFILIATES BE LIABLE TO YOU FOR ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO THIS AGREEMENT, THE SITE, OR ANY PRODUCT PURCHASED.

THE MAXIMUM TOTAL LIABILITY OF COUNTRY ENOUGH AND ITS AFFILIATED ENTITIES TO YOU FOR ANY AND ALL CLAIMS SHALL NOT EXCEED (A) THE FEES YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE LIABILITY, OR (B) IF THE LIABILITY IS NOT RELATED TO A PRODUCT PURCHASE, THE LESSER OF $100.00 OR THE AMOUNT PAID BY YOU TO COUNTRY ENOUGH IN THE ONE (1) MONTH PERIOD PRECEDING THE INCIDENT.

13. Indemnification

You agree to defend and hold Country Enough and its affiliated entities harmless from and against any and all claims, damages, liabilities, costs, and expenses (including attorney’s fees) arising from or related to: (a) your use of the Site, (b) your Submissions, (c) your violation of any part of this Agreement, (d) your infringement on the rights of any third party, or (e) your willful or grossly negligent acts or omissions.

14. Governing Law and Exclusive Venue

This Agreement, and any disputes relating to it, shall be governed by the laws of the State of Oklahoma, without regard to conflict of law principles.

Any dispute arising under this Agreement must be resolved exclusively by the state and federal courts located in Oklahoma County, Oklahoma, and you consent to the personal jurisdiction of these courts.

15. Class Action and Dispute Rules

Class Action Waiver

YOU AND COUNTRY ENOUGH AGREE THAT ALL DISPUTES MUST BE CONDUCTED ON AN INDIVIDUAL BASIS ONLY, AND NOT AS A CLASS ACTION OR OTHER REPRESENTATIVE ACTION. YOU EXPRESSLY WAIVE ANY RIGHT TO FILE OR PARTICIPATE IN A CLASS ACTION LAWSUIT AGAINST US.

Dispute Resolution and Statute of Limitations

If a dispute arises, you agree to first notify Country Enough and attempt to negotiate a resolution in good faith for at least 30 days.

ANY LEGAL CLAIM YOU MAY HAVE MUST BE FILED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION FOR SUCH DISPUTE ACCRUES; OTHERWISE, THAT CLAIM IS PERMANENTLY BARRED.

16. Miscellaneous

Force Majeure: Country Enough is not liable for any delay or failure to perform its obligations if caused by events beyond our reasonable control, including acts of God, fire, flood, utility loss, epidemic, or government acts.

Termination: Country Enough may terminate this Agreement and your access to the Site at any time without notice if, in our sole discretion, you fail to comply with any provision. Upon termination, you must destroy all materials obtained from the Site. All sections intended to survive termination (including IP, Disclaimers, Liability, and Indemnification) shall remain in effect.
